A former University of Pennsylvania professor has decided not to withdraw his no-contest plea and will be resentenced in December for sexually assaulting a graduate student in 2002.
Tracy McIntosh (above), the former director of Penn's Head Injury Center, had been sentenced to 11½ to 23 months of house arrest, but the sentence was vacated after prosecutors complained that it was too light (see related stories).
The prosecutors now say they will seek a sentence of five to 10 years when he is resentenced on December 21st.
Prosecuting attorney Richard DeSipio says the victim is finally receiving justice:
"He admitted the guilt. We've said that he was guilty from the day he was arrested, we stand by that, and it's a pleasure now to be able to call this victim and tell her that justice has been served."
McIntosh's lawyer is Joel Trajani:
"Professor McIntosh has just gone through so much in his life that he is ready to finalize this."
McIntosh had pleaded no-contest to charges stemming from an encounter with a 23-year-old graduate student during which he was accused of drugging and raping her in his office.
The university forced McIntosh to resign after his December 2004 plea.
