Debtor's Rights

These are difficult times for many families and bankruptcy filings are at a record high. However, many are trying to work through paying their debts but are being harassed by debt collectors.

The federal Fair Debt Collection Practices act governs how debt collectors must treat consumers.  For instance, one can only be called between 8 am and 9 pm but not at work if your employer objects.  You can stop a debt collector from contacting you by writing them a letter to that effect. This does not erase the debt though.

You must be informed in writing about the debt and the actions you need to take if you dispute the amount owed. Do not fall to a pitch over the phone pushing debt collection.

And finally, you do have redress if you are upset by the collectors tactics. Report the collector to the state's Attorney General. You also have the right to sue a collector in state or federal court.
