The attorney for a Lower Merion chiropractor accused of hiring a hitman to kill his wife is asking a judge in Montgomery County to grant bail for his client.
Alan Kushner (in file photo above) has been behind bars since late October when he was arrested on charges that he conspired to have his estranged wife killed.
Prosecutors say the Kushners are going through a bitter divorce. And with $7 million at stake, they say, the 58-year-old doctor hired a hit man.
Defense attorney Frank DeSimone says he hasn’t seen enough evidence in this case to warrant holding his client without bail:
"He’s never done anything before in the past, and I believe that with all the conditions that we put in there -- that she has private security, that he’s on electronic monitoring -- I would think and hope that she’s safe.”
Sarran Kushner was shot in the wrist in the driveway of her Bala Cynwyd home in May. Prosecutors still don’t know who pulled the trigger, but prosecutor Tom McGoldrick says her life is clearly in danger if the doctor is allowed out:
"There are no bail conditions that can ensure the safety of the wife in this case. She was shot once and we do not think that the defendant will hesitate to act again.”
Prosecutors say they have witnesses who claim Kushner made inquiries about having his wife killed.
A ruling from the judge is expected next week.
