Judge Rules Seth Williams Cannot Run for DA in Phila.

One of the five democratic candidates running for Philadelphia district attorney has been kicked off the May 5th primary ballot.

A judge's ruling removes Philadelphia District attorney candidate Seth Williams' (file photo) name from the May Democratic primary ballot.

Common Pleas court Judge Allan Tereshko ruled Seth Williams failed to report as income more than $10,000 that he received as reimbursements from his campaign committee.

Williams' campaign manager, Dan Fee, calls the decision "fundamentally flawed":

"Reimbursements are not considered income by the internal revenue service, Pennsylvania department of revenue, or the Pennsylvania ethics commission. Judge Tereshko is just plain wrong."

Fee says the campaign will file an appeal on Monday.

In a separate ruling, Judge Tereschko says Mike Turner's name can stay on the ballot, despite questions regarding his nominating petitions.

Williams and Turner are two of five democrats vying to succeed DA Lynn Abraham who is not running for re-election.
