The Pennsylvania Supreme Court has reaffirmed that viewing child pornography online is a crime, even if it was not intentionally stored on a computer.
The Pennsylvania Supreme Court has ruled that accessing and viewing child pornography on the Internet does constitute “control” of the images.
In a case involving a Delaware County man, state police testified they used forensic software to locate 370 images of child porn that had been automatically stored in his computer’s cache files and in unallocated space on the hard drive.
In an appeal, the man’s lawyer argued that was insufficient to prove his client had “knowing” possession of child pornography.
But the state high court concludes that the defendant had “knowing control” of child porn when he intentionally clicked on images from different websites for the purpose of viewing them.
