Judge to Set Sentencing Guidelines for Vince Fumo

A federal judge is expected to rule on Thursday on the so-called guideline sentence for convicted former State Senator Vince Fumo. Fumo is scheduled to be sentenced on Tuesday.

A probation department report set the guideline sentence for Vince Fumo at about 21 to 27 years in prison, but the defense argued that it should be lower on numerous grounds (see Fumo related stories).

But prosecutors agreed with the probation department's guidelines, which included an enhancement for perjury. Prosecutor Robert Zauzmer told the court on Wednesday that Fumo lied on the witness stand extensively, repeatedly, hour after hour:

"There is no way in this case to look at the verdict other than a rejection of everything Mr. Fumo testified on every material matter."

The judge is expected to announce the guideline sentence as he sees it on Thursday, but he is still free to depart above or below the guideline based on specific arguments by both sides at sentencing.
