Phila. Smoking Ban Not a Done Deal for Some Bars

Many of Philadelphia’s small taverns could soon be preparing to apply for an exemption to the smoking ban that was passed by City Council last week.

 

The smoking ban still awaits Mayor Street’s signature. If he signs it, neighborhood taverns that have 10 percent or less of their business from food would be eligible to apply for an exemption to allow smoking.

 

The 10 percent limit was a political compromise -- some wanted a higher figure that would make more bars eligible. City councilman Michael Nutter understands some bars may miss the cutoff:


“In most situations, a line is drawn, a definition is made, and a boundary is created. That’s just a normal part of life, and business.”

Nutter cautions against bars against cooking the books to show they’re doing less cooking.

 

The bars would also have to show they’re up-to-date on licenses and taxes before getting an exemption.
