Amid the city’s homicide crisis, two Philadelphia city councilmembers have filed a lawsuit against Pennsylvania state lawmakers for failing to let Philadelphia enact its own gun laws.
It may be a legal long shot, but city councilmembers Darrell Clarke and Donna Miller are suing the state General Assembly for not letting Council pass gun restrictions for Philadelphia.
Councilman Clarke (in file photo at right):
”Those small children, and the citizens of the City of Philadelphia, are getting shot down on a daily basis. We have to do something.”
The lawsuit will attack the state code that prohibits individual cities from passing gun laws. The attorney for the councilmembers predicts this could end up in the state Supreme Court.
Clarke first promised this lawsuit back in May, when Council passed eight gun restrictions that, at this point, still lack the consent of Harrisburg.
